Encroachments

When a property owner’s structure or feature such as a driveway, parking area, fence, shed, or other improvement extends beyond their property line and onto City land,  the City requires an Encroachment Agreement. An Encroachment Agreement is a formal, legally binding contract between the property owner and the City. If approved, it allows the property owner to continue using the portion of City property for a specific purpose, under clearly defined terms.

Procedure for Encroachment

All applications for encroachment agreements are to be received in the Clerk’s office.

Once submitted, completed encroachment applications and drawings are reviewed by the Clerk’s Office and City departments who may request changes. Once finalized, the agreement is presented to the Planning and Development Committee, then to City Council for a decision. Committee meetings are held the first Tuesday of each month, and applications must be received at least two weeks in advance. Council meets on the second and fourth Tuesday of each month (once in July and August).  Property owners must carry $2 million liability insurance naming the City as an additional insured and agree to protect the City from any related claims.

The City of Brockville fee for processing the agreement is outlined in our Annual Fees and Service Charges By-law. In 2025, the fee for an encroachment agreement is $300.00
