    What Brockville Homeowners Need to Know Before They Build

    Spring is a popular time for outdoor projects, and deck construction is one of the most common projects requiring City approval. Before starting any work, homeowners are reminded that zoning compliance and a building permit are required for most deck projects in the City of Brockville.

    Applying early and submitting complete, accurate information helps avoid delays, unexpected costs, and safety concerns during construction.

    Do I Need a Permit to Build a Deck?

    Building permits are not just administrative, they help ensure safety, proper construction, and compliance with codes and bylaws.

    A building permit is required  and deck construction must comply with the Ontario Building Code if any of the following apply:

    • The deck is attached to a house
    • The deck surface is more than 600 mm (24 inches) above finished grade, requiring guards
    • The deck occupies a ground area greater than 108 square feet
    • The deck serves the principal entrance or an exit door
    • The deck supports a roof, enclosure, or privacy wall

    Even where a building permit may not be required, zoning regulations still apply.

    Zoning Requirements for Residential Properties

    All decks must comply with City of Brockville Zoning By‑law No. 050‑2014, as amended. Zoning regulations control where a structure may be located on a property.

    Most detached homes in Brockville are located within Residential Zones.

    Typical Residential Setbacks for Decks

    • Rear Yard
      • 7.5 m minimum or 6.0 m minimum, depending on your zone.
    • Interior Side Yard
      • 1.2 m minimum or 1.0 m minimum, depending on your zone
    • Exterior Side Yard (corner lots)
      • 4.5 m minimum or 3.0 m minimum, depending on your zone

    Yard Projections for Porches, Steps, and Decks

    (Zoning By‑law No. 050‑2014)

    The Zoning By‑law permits limited projections into required yards for certain porches, steps, and decks, subject to specific height and setback limits:

    • Porches and stairs (covered or uncovered) may project up to 1.5 m into required front, rear, or exterior side yards, provided the structure is no higher than 1.5 m above grade.
    • In interior side yards, the main building setback applies, except for steps not higher than 0.5 m above grade.
    • Stairs leading to areas below grade are permitted in side or rear yards and may project up to 1.5 m into a required rear yard only.
    • Uncovered decks may project:
      • Up to 1.5 m into required front or exterior side yards, provided they are no higher than 4.0 m above grade
      • Up to 3.75 m into a required rear yard, provided they are no higher than 1.5 m above grade

    These projection allowances do not override minimum setbacks, and elevated decks are often required to fully comply with required yard setbacks.

    Additional Zoning Considerations

    • A minimum of 35% or 40% landscaped open space is required on residential lots, depending on what zone you are located in.
    • Decks contribute to lot coverage calculations
    • Corner lots, downtown/waterfront areas, and environmentally regulated lands may have additional restrictions

    If a deck does not meet zoning requirements, it may need to be redesigned or require approval of a Minor Variance before a permit can be issued.

    Deck Construction on New Homes in Subdivisions

    For homeowners in new subdivisions or recently constructed homes, there is an important additional consideration before applying for a deck permit.

    New homes are typically subject to a grading and drainage plan approved as part of the subdivision development. Before constructing a deck, homeowners should confirm with their builder that the final lot grading has been completed and accepted by the City.

    Constructing a deck before final grading approval can lead to complications, including:

    • Conflicts with approved drainage patterns
    • The need to modify or remove the deck to complete grading works
    • Delays in obtaining final grading clearance from the City

    If you are unsure whether final grading has been completed and accepted, consult your builder or developer before proceeding with a permit application.

    Applying for a Permit Using Cloudpermit

    The City of Brockville accepts building permit applications online through Cloudpermit.

    How to Apply

    1. Create or log in to your Cloudpermit account
    2. Start a permit application:
      • Accessory Structure
      • Work Type: New
      • Work Target: Deck – Residential
    3. Enter property, owner, and project details
    4. Upload required documents (PDF format)
    5. Submit the application for review

    Required Submission Documents

    • Completed Building Permit Application and required Cloudpermit forms
    • Site Plan or Survey, showing:
      • Property lines and dimensions
      • Existing buildings
      • Proposed deck with setbacks to all lot lines
    • Construction Drawings, including:
      • Deck layout and dimensions
      • Framing plan (joists, beams, posts – sizes, spacing, and spans)
      • Footing and pier details
      • Guard and stair details
      • Ledger board connection (if attached)
      • Deck height above grade
    • Manufacturer documentation for composite decking or engineered railing systems
    • Schedule 1: Designer Information Form (if required)
    • Payment of the applicable permit fee

    Incomplete or unclear applications are the most common cause of processing delays.

    Building Permit Fees

    The 2026 building permit fee for a residential deck is calculated as:

    The greater of:
    $238.00, or
    $0.51 per square foot of deck area

    Permit fees must be paid before the permit is issued.

    How to Pay

    Permit fees may be paid by:

    • Credit card (through Cloudpermit)
    • Debit
    • Cash
    • Cheque

    Payment instructions will be provided once the application review is complete and fees are confirmed.

    Can I Prepare My Own Deck Plans as a Homeowner?

    Yes, in most cases.

    Under the Ontario Building Code, a homeowner may prepare and take responsibility for the construction drawings of a simple residential deck, provided that:

    • You are the property owner
    • The deck is for your own use
    • The project falls within Part 9 of the Ontario Building Code
    • The design is not unusually complex

    You may prepare your own plans if the deck:

    • Is a typical residential deck
    • Uses standard construction methods
    • Does not support a roof or enclosure requiring engineering

    Drawings must be clear, accurate, and complete enough for review and construction.

    When a Qualified Designer Is Required

    A qualified designer (engineer or registered BCIN designer) is required if:

    • The deck is for a building that is not a house or has more than two residential suites
    • Non‑prescriptive structural elements are used
    • The design does not follow standard Ontario Building Code provisions
    • You are not the property owner

    In these cases, a BCIN and Schedule 1 form completed by the qualified designer must be provided.

    Permit Review Process

    The Ontario Building Code sets a 10 business day review timeline for residential deck permit applications, provided submissions are complete.

    Once an application is submitted, the City will complete:

    1. Zoning review (Planning Services)
    2. Building Code review (Building Services)
    3. Requests for revisions, if required
    4. Permit issuance, including stamped drawings

    Construction may not begin until the permit is issued.

    Required Inspections During Construction

    Inspections must occur at key stages:

    1. Footing / Pier Inspection – before concrete is poured
    2. Framing Inspection – before decking is installed
    3. Final Inspection – upon completion of all work

    Work must remain visible until inspected and approved.

    Common Deficiencies and Approval Issues

    • Decks built too close to property lines
    • Footings not extending below frost depth
    • Ledger boards attached to brick veneer
    • Missing or improper flashing
    • Deck blocks used for attached decks
    • Guards below minimum height or climbable
    • Non‑uniform stair risers
    • Improper beam fastening or excessive cantilevers
    • Structural connections using wood screws instead of approved fasteners
    • Missing required guards
    • Construction changes made without approval

    Building Without a Permit

    Starting construction without required approvals may result in:

    • Stop‑work orders
    • Fines or additional fees
    • Removal of non‑compliant construction
    • Delays during sale or refinancing of the property
    • Complications with insurance coverage
